In a setback for Apple, the International Trade Commission ruled on Tuesday that Apple infringes on one of Motorola's patents. The patent describes a "method and system for generating a complex pseudonoise sequence for processing a code division multiple access signal." ITC Judge Richard Pender also said Apple did not violate three other patents Motorola included in its original complaint

Florian Mueller over at FOSS Patents noted yesterday that Apple's patent infringement case against Motorola Mobility has been dealt a nearly fatal blow in the courts of the United States International Trade Commission (ITC). The suit alleged that Motorola Mobility was infringing on three Apple patents: one all-important patent for a multipoint touchscreen, an "object-oriented system locator system" patent, and a patent for an "ellipse fitting for multi-touch surfaces." The ITC's preliminary ruling in January found no proof that Moto was infringing on Apple's patents, and Friday's final ruling (PDF) upheld the initial finding

HTC’s chief executive officer Peter Chou recently said his company has already developed a solution to dodge an ITC injunction, which was issued after a ruling that found HTC guilty of infringing two of Apple’s patents . “It’s actually quite rarely used,” Chou said of the feature that violates Apple’s patents, suggesting that the company isn’t afraid of the ban that is set to take effect on April 19th.

The International Trade Commission has delayed its ruling on the pending patent case between HTC and Apple, according to HTC itself. This is the second delay on the ruling, originally set for December 6 and then moved back to this week, which is now set for release on December 19. Apple of course, is complaining that the HTC used some of its patented technology in making Android phones, and is trying to enforce a cease-and-desist on HTC selling those phones
